Reporting a privacy breach/concern

A privacy breach happens when personal or health information is handled the wrong way.
This includes:

  • Someone who should not see the information gets access

  • Information is sent to the wrong person (for example, a fax or email)

If you think your personal or health information has been improperly collected, used, accessed, lost and/or disclosed by an employee or medical staff working at CapitalCare, contact CapitalCarePrivacy@capitalcare.net.

Information access

  • Personal information requestTo submit an Access to Information Act (ATIA) request for personal or business (not health) information or requests for correction of personal information under the Protection of Privacy Act (POPA) contact CapitalCarePrivacy@capitalcare.net.

  • Health information requestAll residents, clients, patients, and participants at CapitalCare have a health record. These records contain health information such as reports from care providers, test results or information about medication. Information on how to request health records can be found here.

Protection of Privacy Act (POPA)

What is POPA?

The Protection of Privacy Act (POPA) is legislation in Alberta (started June 2025) that protects people’s personal information in the public sector. It replaced part of the old Freedom of Information and Protection of Privacy (FOIP) legislation and applies to all public organizations in Alberta. [alberta.ca]

Access to Information Act (ATIA)

What is ATIA?

In June of 2025, the Government of Alberta separated the FOIP Act into two acts: the Protection of Privacy Act (POPA) and the Access to Information Act (ATIA).

The Access to Information Act:

  • Enables people to ask for and receive information from public organizations in Alberta

  • Helps make government and public bodies open and accountable

  • Protects private and confidential information so organizations can work properly

Health Information Act (HIA)

What is HIA?

The Alberta Health Information Act governs how health information can be collected, used and shared.

Under this law, you have a right to:

  • Access your own health information

  • Request corrections

  • Have your health information kept private

  • Know why your health information is being collected, used and shared

  • Share your wishes about who can see your health information, and have those wishes considered

  • Ask for an independent review if you disagree with a decision about your information. You must do this within 60 days of being notified of the decision.
